Terms of Service
Last updated September 15, 2026
These Terms of Service (the “Terms”) govern your use of evidence-check.com (the “Service”), operated by TopDWI (“TopDWI,” “we,” or “us”). By signing in, you (“you”) agree to these Terms.
1. Pilot Access
The Service is in a pilot phase. We grant access only to users we invite, and we may suspend or end any user’s access at any time. We provide the pilot without charge unless you and we agree otherwise in a separate signed writing.
2. Not Legal Advice
The Service produces analytical records that identify possible evidentiary issues in Missouri Alcohol Influence Report packets. The Service does not provide legal advice, does not form an attorney-client relationship with anyone, and does not replace the independent judgment of a licensed attorney. You must independently verify every finding, rule, and authority before relying on it in any matter.
3. Your Responsibilities
You agree that you will:
- keep your sign-in credentials secure and not share your account;
- upload only records you have the right to use and process;
- comply with your professional obligations, including client confidentiality; and
- not reverse engineer, overload, or attempt to gain unauthorized access to the Service.
4. Your Content
You keep all rights in the records you upload. You grant us a limited license to process those records solely to provide the Service to you. The Privacy Policy describes how we handle that information.
5. Our Property
We own the Service, including its software, rule sets, and design. These Terms do not transfer any of those rights to you.
6. Disclaimer of Warranties
WE PROVIDE THE SERVICE “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW PERMITS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
7. Limitation of Liability
TO THE FULLEST EXTENT THE LAW PERMITS, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR CASE OUTCOMES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
8. Termination
You may stop using the Service at any time. We may suspend or end your access under Section 1. Sections 2, 4, 5, 6, 7, and 9 survive termination.
9. Governing Law
Missouri law governs these Terms, without regard to its conflict-of-law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in St. Louis County, Missouri.
10. Changes and Contact
We will post any change to these Terms on this page and update the date above. Send questions to [email protected].
